1. Acceptance of Terms
By accessing or using the FixiFind platform ("Platform"), website, or mobile experience, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.
These Terms constitute a legally binding agreement between you and FixiFind ("Company," "we," "our," or "us"). We reserve the right to modify these Terms at any time, and your continued use of the Platform constitutes acceptance of any modifications.
2. Description of Service
FixiFind is a local services marketplace that operates a three-tier model connecting customers with verified service providers through trusted local Area Managers. The platform facilitates:
- Customers discovering and booking verified local service providers.
- Service Providers listing their skills and receiving bookings through the platform.
- Area Managers overseeing and coordinating service providers within their designated locality.
- Administrators managing platform operations, approvals, and quality standards.
FixiFind acts as an intermediary marketplace and is not itself a service provider. All services are rendered by independent third-party service providers listed on the platform.
3. User Accounts and Registration
To use most features of FixiFind, you must register for an account. By creating an account, you agree to:
- Provide accurate, current, and complete registration information.
- Maintain the security of your password and promptly notify us of any unauthorised account access.
- Be responsible for all activities that occur under your account.
- Not create multiple accounts for deceptive purposes or to circumvent platform restrictions.
- Be at least 18 years of age to create an account and use the platform.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or harm the platform or its users.
4. Service Provider Terms
If you register as a Service Provider on FixiFind, you additionally agree to:
- Approval Process: Your profile must be approved by FixiFind or an assigned Area Manager before you can receive bookings. We reserve the right to reject or revoke approval at our discretion.
- Accurate Information: Maintain accurate service descriptions, experience details, and contact information on your profile.
- Service Quality: Provide services professionally and to the standard described in your profile.
- Payment: Agree to the commission and payout terms as communicated by FixiFind or your assigned Area Manager at the time of onboarding.
- Response Time: Respond to booking requests promptly and honour confirmed bookings.
- Compliance: Hold any licences, certifications, or qualifications required by law for the services you offer.
5. Area Manager Terms
Area Managers operate as franchisees of the FixiFind platform within their designated locality. By accepting the Area Manager role, you agree to:
- Franchisee Model: Act as a local representative responsible for recruiting, onboarding, and managing service providers in your area.
- Provider Oversight: Ensure providers under your management maintain quality standards and professional conduct.
- Booking Management: Confirm, reject, and mark bookings for providers you manage.
- Commission: Earn commission on bookings completed by providers under your management, per the terms agreed upon with FixiFind administration.
- Exclusivity: Not simultaneously operate as an Area Manager for a competing services platform without prior written approval from FixiFind.
- Compliance: Ensure all providers in your network comply with FixiFind's standards and applicable laws.
6. Customer Terms
As a customer on FixiFind, you agree to the following:
- Booking: Booking requests are sent to providers for confirmation. A booking is not confirmed until the provider or area manager accepts it.
- Accurate Requests: Provide accurate descriptions of the service required. Misrepresentation may result in booking cancellation.
- Payment: Pay for services after completion through the FixiFind platform or as otherwise agreed with the provider.
- Reviews: Submit honest and accurate reviews based on your genuine experience with the service provider.
- Conduct: Treat service providers with respect. Harassment, abuse, or threatening behaviour is strictly prohibited and may result in account suspension.
7. Payment Terms
FixiFind processes payments through Cashfree Payments and Razorpay. The following payment terms apply:
- Pay After Service: Customers are not required to pay at the time of booking. Payment is made after the service is completed and an amount is set by the provider.
- Processing Fee: A convenience fee of 1.75% of the service amount is added to cover Cashfree's payment processing costs. This fee is displayed transparently before payment confirmation.
- Service Amount: The full service amount (excluding the processing fee) goes directly to the service provider.
- Currency: All transactions are processed in Indian Rupees (INR).
- Payment Security: All payments are processed through PCI-DSS compliant payment gateways. FixiFind does not store your card details.
- Failed Payments: In the event of a failed payment where funds were deducted, contact us immediately at fixifind@gmail.com with your booking ID.
8. Cancellation and Refund Policy
- Customer Cancellation: Customers may cancel a pending booking before it is confirmed by the provider. Once confirmed, cancellations must be communicated directly to the provider.
- Provider Cancellation: Providers may reject pending bookings. Repeated last-minute cancellations may result in account review or suspension.
- Refunds: If a payment was made and the service was not rendered, please contact us at fixifind@gmail.com within 7 days. Refund eligibility is assessed case-by-case.
- Processing Time: Approved refunds are processed within 5–10 business days, depending on your bank or payment method.
9. Prohibited Activities
The following activities are strictly prohibited on FixiFind:
- Creating fake accounts, reviews, or bookings.
- Circumventing the platform to transact directly with providers to avoid platform fees, after an initial platform connection.
- Harassing, threatening, or abusing other users, providers, or FixiFind staff.
- Posting false, defamatory, or misleading reviews or service descriptions.
- Using the platform for any unlawful purpose or in violation of applicable Indian laws.
- Attempting to reverse-engineer, scrape, or exploit the platform's technical infrastructure.
- Impersonating another person or entity.
10. Limitation of Liability
FixiFind is a marketplace platform and does not directly provide the services listed. To the maximum extent permitted by applicable law:
- FixiFind is not liable for the quality, safety, legality, or any other aspect of the services provided by independent service providers.
- We are not responsible for any loss, damage, injury, or dissatisfaction arising from services rendered by providers listed on our platform.
- Our total liability to you for any claims arising from your use of the platform shall not exceed the amount you paid to FixiFind in the 3 months preceding the claim.
- We do not guarantee the availability, accuracy, or completeness of any service provider's profile or listing.
We strongly recommend verifying a provider's credentials and reviews before booking, and ensuring your service location is safe and accessible.
11. Intellectual Property
All content on the FixiFind platform — including but not limited to the logo, design, text, graphics, and software — is the intellectual property of FixiFind and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India, with exclusive jurisdiction in the courts of Kerala, India.
In the event of a dispute, we encourage you to first contact us at fixifind@gmail.com to resolve the matter amicably. If a resolution cannot be reached within 30 days, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.
